Unresponsive wakefulness syndrome (UWS, previously known as vegetative state) occurs after patients survive a severe brain injury. Patients suffering from UWS have lost awareness of themselves and of the external environment and do not retain any trace of their subjective experience. Current data demonstrate that neuronal functions subtending consciousness are not completely reset in UWS; however, they are reduced below the threshold required to experience consciousness. The critical factor that determines whether patients will recover consciousness is the distance of their (...) neuronal functions from this threshold level. Recovery of consciousness occurs through functional and/or structural changes in the brain, i.e., through neuronal plasticity. Although some of these changes may occur spontaneously, a growing body of evidence indicates that rehabilitative interventions can improve functional outcome by promoting adaptive functional and structural plasticity in the brain, especially if a comprehensive neurophysiological theory of consciousness is followed. In this review we will focus on the pathophysiological mechanisms involved in UWS and on the plastic changes operating on the recovery of consciousness. (shrink)

In the tradition of justified true belief theory, I provide an epistemic responsibility-based philosophical analysis of collective knowledge which is both coherentist and reliabilist.

Given the hundreds of articles and books that have been written in epistemology over the span of just the past few decades, relatively little has been written specifically on epistemic responsibility. What has been written rarely considers the nature of epistemic responsibility and its possible role in epistemic justification or knowledge. Instead, such work concerns philosophical analyses and arguments about related concepts such as epistemic virtues or duties, rather than epistemic praiseworthiness and blameworthiness.2 It is epistemic responsibility in the blameworthiness (...) and praiseworthiness senses that is the primary concern of this paper, though the duty sense of epistemic responsibility is explored in terms of its pertinence to epistemic virtue. This paper explicates and challenges John Rawl's argument concerning a rule-utilitarian theory of punishment. In so doing, it argues in favour of a retributivist theory of punishment, one that seeks to justify, not only particular forms of punishment, but the institution of punishment itself. Some crucial objections to retributivism are then considered: one regarding the adverse effects of punishment on the innocent, another concerning proportional punishment, a third pertaining to vengeance and retribution, a Marxian concern with retributive punishment, and a (...) concern with the concept of desert. Each objection is deflected in order to ward-off what seem to be the most serious criticisms of a retributivist view of punishment and to clarify the depth of the retributivist position. (shrink)

This paper seeks to provide some of the roles of philosophy in the field of academic ethics.

In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. What makes for excellence in research, teaching and service is explored in some detail, with attention paid to the contexts of four-year colleges and comprehensive universities in the united states.

Digital contact tracing is used in different countries to help contain the COVID-19 pandemic. It raises challenging empirical and ethical questions due to its complexity and widespread effects calling for a broader approach in ethical evaluation. However, existing approaches often fail to include all relevant value perspectives or lack reference to empirical data on the artifact in question. In this paper, we describe the development of an interdisciplinary framework to analyze digital contact tracing from an empirical and ethical perspective. Starting (...) with an analysis of methodological tensions in the attempt to analyze digital contact tracing, we, firstly, set out three methodological premises regarding (a) a specific view of technology, (b) a fruitful normative perspective, and (c) ways to gather empirical knowledge about the object under investigation. Secondly, we inspect consequences of these premises to develop our research methodology. In doing so, we argue for a postphenomenological perspective on technology, solidarity as an important concept to guide the ethical perspective, and an empirical approach based on qualitative social science research and the concept of affordances. We illustrate these considerations by referring to our analysis of the German Corona-Warn-App as an instance of contact tracing based on the Exposure Notification Framework by Google and Apple. We then discuss the implications of using such a framework, including considerations concerning future developments of technologies similar to or inspired by the current concepts of contact tracing. A philosophical assessment of Richard Dawkins’ The God Delusion, exposing some errors of reasoning that undermine part of the foundation of his atheism. Distinctions between theism, atheism and agnosticism are also provided and explored for their significance to Dawkins’ argument.

In this paper I shall discuss various philosophical theories of collective punishment: marxian annihilism, metaphysical collectivism and methodological individualism. After refuting metaphysical collectivism and its modified version, I defend a modification of methodological individualism.

Health technologies such as apps for digital contract tracing [DCT] played a crucial role in containing and combating infections during the COVID-19 pandemic. Their primary function was to prevent the spread of SARS-CoV-2 by consistently generating and disseminating information related to various events such as encounters, vaccinations or infections. While the functionality of DCT has been well researched, the necessity of transparency in the use of DCT and the consent to share sensitive information such as users’ health, vaccination and location (...) status remains unclear. On one hand, DCT enabled the continuous monitoring of various risk factors, including data-based calculations of infection probabilities. On the other hand, digital monitoring of health risks was closely associated with various uncertainties, such as the ambiguous storage of personal data and its potential future misuse, e.g., by tech companies or health authorities. Our contribution aims to retrospectively analyze the COVID-19 pandemic from a post-pandemic perspective and utilize it as a case study for the implementation of new technological measures. We argue that under the condition of voluntary use of DCT, transparency plays a key role in convincing individuals to install health technologies on their mobile devices, keep them activated and consent to the sharing of sensitive data. We support our argument with qualitative data from an expert survey conducted between 2020 and 2021 and analyzed according to the principles of Grounded Theory. (shrink)

El presente trabajo se propone exponer el carácter problemático de la base sistemática de la estética hegeliana desarrollada en la Enciclopedia a partir del análisis de algunas de sus temáticas centrales y de las modificaciones que sufren en las tres ediciones de esta obra. Primero se examina la definición enciclopédica del ideal y la noción de obra de arte contenida en ella. Luego se aborda la disputada cuestión de la autonomización del arte respecto de la religión. Conhecido como Debate Hart-Dworkin, o entrechoque de opiniões entre esses dois autores gerou intensa discussão acerca do positivismo jurídico e das teorias que buscam refutar suas teses fundamentais. Neste contexto, Ronald Dworkin se empenha em repreender a doutrina positivista demonstrando que as noções elementares dessa teoria não são capazes de produzir uma doutrina eficaz sobre a natureza do direito. No presente artigo, pretendo analisar as críticas lançadas por Dworkin ao positivismo jurídico e às conceituações de Herbert Hart, com específica atenção (...) para o conceito de discricionariedade que Dworkin imputa ao positivismo. A partir de uma discussão teórica envolvendo as principais obras desses autores, procuro confirmar a hipótese de que a teoria positivista moderna não está comprometida com o sentido atribuído por Dworkin à noção de discricionariedade, prejudicando assim o fundamento da crítica de Dworkin acerca da interpretação no positivismo jurídico. Ao final, irei considerar também a gravidade desta vicissitude para a teoria dworkiniana como um todo, avaliando se as críticas de Dworkin restam comprometidas ou resistem a este empecilho. (shrink)

Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

The history of scholarship, philosophical or otherwise, about Plato and his writings reveals a quandary pertaining to the interpretation of the contents of Plato's dialogues. To understand Plato one must come to terms with this problem: how ought Plato's writings to be interpreted?

This paper summarizes some of the major concepts of Raimo Tuomela’s social ontology as it is articulated and defended in his most recent major works and provides a set of objections to it. It also suggests some ways to plausibly revise Tuomela’s analysis of social groups in order to evade our concerns.

This paper amounts to a reply to Professor Donald G. Brown’s thoughtful comment on my “Ethical Issues in Journal Peer-Review”, which appeared in this journal.

In a recent paper in this journal Charles B. Saunders et al. argue that corporations have no social responsibility regarding alienation in the workplace in that there is no significant degree of alienation in the workplace, at least in white collar and management level positions in corporate America.Contrary to Saunders et al., this paper defines the concept of alienation. Having done that, it proceeds to show that the argument Saunders et al. make flounders on logical grounds. I conclude that Saunders (...) et al. provide no evidence for the claim that alienation is lacking (in any degree) in corporate America. (shrink)

It has recently been argued that there is probably no theory of punishment to be found in Immanuel Kant’s writings, but that “if one selects carefully among the many remarks and insights that Kant has left us about crime and punishment, one might even be able to build such an edifice from the bricks provided.” In this paper, I seek to provide part of a foundation of a Kantian theory of punishment, one which is consistent with many, if not all, (...) of Kant’s own insights on justice. In his famous essay, "A Puzzle About Belief," Saul Kripke poses a puzzle regarding belief. In this paper I shall first describe Kripke's puzzle. Second, I shall introduce and examine five positions one might take in attempting to solve Kripke's Puzzle. In so doing, I shall show why each of these attempts fails to solve Kripke's Puzzle. The significance of this analysis is that if Kripke's Puzzle remains unresolved, then (as Kripke himself claims) the normal apparatus for belief ascription needs (...) rethinking. (shrink)

This paper is an elaboration of my previous paper published in Philosophy, ‘Making Sense of retributivism,’ which was a criticism of John Rawls' attempt in ‘Two Concepts of Rules’ to develop a rule utilitarian theory of punishment wherein utilitarianism is best construed as a justificatory basis for the institution of punishment and retributivism is best construed as serving as a justificatory basis for particular forms of punishment. I challenge this claim, arguing that retributivism must and can provide a justification both (...) for the institution of punishment and for particular forms of punishment. In the end, I develop an analysis of the nature of desert as responsibility and proportionality. This notion of desert makes the best sense of retributivism. (shrink)

This paper is offered as a tribute to Joel Feinberg. The first section of the paper applies Feinberg's analysis of freedom of expression to a contemporary case of academic freedom. The second section engages Feinberg's work on rights and punishment. The paper ends with numerous quotations from Feinberg's vast array of writings, words that express his ideas on a number of important problems that occupied his mind throughout his fruitful and influential career.

This paper challenges the claim that the traditional Christian (Augustinian, Thomistic, Anselmian) idea of hell as a form of eternal punishment (damnation and torment) for human sin cannot be made consistent with the idea of proportionate punishment, and it raises concerns with the notion that divine justice requires divine forgiveness and mercy. It argues that divine justice entails or at least permits retribution as the meting out of punishment by God to those who deserve it in proportion to the degree (...) and amount of harm unduly and responsibly caused by sinners to others. For God to fail to punish those who deserve it in proportion to their harmful wrongdoings would imply God’s failure to be both just and omnibenevolent. (shrink)
